By accessing or using FlyMX ("the Service"), operated by FlyMX LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. We reserve the right to modify these terms at any time, and your continued use of the Service constitutes acceptance of any changes.
FlyMX is a general aviation management platform that provides flight logging, engine health monitoring, aircraft maintenance tracking, compliance monitoring, airworthiness directive (AD) tracking, marketplace services, and related tools. The Service is designed for informational and record-keeping purposes and is not a substitute for professional aviation maintenance, legal, or regulatory advice.
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized use of your account.
FlyMX offers free and paid subscription tiers for pilots. Paid subscriptions are billed monthly or annually through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Refunds are provided at our sole discretion and in accordance with applicable law.
The FlyMX Marketplace allows aviation service providers ("Shops") to list their services and advertise to pilots. Shops may choose from advertising tiers (Free, Basic, Featured, or Premium) billed monthly through Stripe. FlyMX does not guarantee any specific number of leads, impressions, or conversions. FlyMX is not a party to any transaction between pilots and Shops and is not responsible for the quality, safety, legality, or any other aspect of services provided by Shops.
Insurance provider listings on FlyMX are for informational purposes only. FlyMX is not a licensed insurance broker, agent, or advisor. Any insurance-related content, recommendations, or listings do not constitute insurance advice. You should consult a licensed insurance professional before making any insurance decisions.
Flight data, engine health analytics, oil analysis interpretations, and compliance tracking provided by FlyMX are for informational purposes only. While we strive for accuracy, we do not warrant that any data, analysis, or recommendation is error-free. You are solely responsible for verifying all aviation data, maintaining compliance with FAA regulations, and making operational decisions regarding your aircraft. FlyMX is not an FAA-approved data source.
The AD Checker feature uses AI-powered analysis to help identify potentially applicable airworthiness directives. This tool is strictly informational and does not replace official FAA AD searches, your A&P mechanic's professional judgment, or any regulatory requirement. You must always verify AD applicability through official FAA channels and consult with a certificated mechanic or inspector.
The multi-user mechanic access feature allows aircraft owners to grant limited access to their aircraft data to A&P mechanics. The aircraft owner is responsible for managing mechanic permissions and ensuring that shared data is appropriate. FlyMX does not verify the credentials, certifications, or qualifications of any mechanic granted access through the platform.
You retain ownership of content you submit to FlyMX, including reviews, photos, and maintenance records. By submitting content, you grant FlyMX a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service. You agree not to submit content that is false, defamatory, infringing, or otherwise unlawful. We reserve the right to remove any content that violates these terms.
The Service, including its design, features, code, and content (excluding user-submitted content), is owned by FlyMX LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYMX LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. FLYMX IS NOT LIABLE FOR ANY AVIATION INCIDENT, MAINTENANCE DECISION, OR REGULATORY NON-COMPLIANCE ARISING FROM YOUR USE OF THE SERVICE.
You agree to indemnify, defend, and hold harmless FlyMX LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these terms, or your violation of any rights of a third party.
We may suspend or terminate your account at any time for any reason, including violation of these terms. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination. Provisions that by their nature should survive termination shall survive, including limitation of liability and indemnification.
These terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the state or federal courts located in Orange County, Florida.
